La app ANIMAEC es una asistente virtual que brinda apoyo y guía para el autocuidado de la salud mental. Es parte de la iniciativa ANIMAEC la cual también ofrece una línea de ayuda para soporte emocional y diferentes actividades periódicas de educación y orientación psicológica en línea.

TERMINOS Y CONDICIONES DE USO ANIMA EC
Por favor lea cuidadosamente estos términos y condiciones de uso antes de utilizar ANIMA EC (una "Aplicación Móvil")
ANIMA EC, tal como se utiliza en el presente Acuerdo, incluye cualquier programa y servicio que se acceda o se use a través de su dispositivo móvil, así como los módulos de software que operan dentro del entorno de aplicación y que aparecen en su móvil.
Mediante el uso de ANIMA EC, usted reconoce y acuerda a todo y cada término y condición establecidos en el presente Acuerdo. Si no acuerda a todos estos Términos y Condiciones de uso, ¡no utilice ANIMA EC!
El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, como propietario de la Aplicación ANIMA EC, puede revisar y actualizar estos Términos y Condiciones en cualquier momento. Su uso continuo de ANIMA EC significará que usted acepta esos cambios.
Como se usa en el presente Acuerdo, "Colaboradores" se refiere a Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, Servicios de Salud Mental del Instituto de Neurociencias, y toda persona y entidad que ha hecho aportaciones y/o ayudado a desarrollar la aplicación móvil ANIMA EC.
ANIMA EC NO PROPORCIONA CONSEJO MÉDICO
El contenido de la Aplicación Móvil ANIMA EC, tal como texto, gráficos, imágenes, información obtenida de los concedentes de ANIMA EC y otros materiales contenidos en ANIMA EC es sólo para fines informativos y de psicoeducación. El Contenido no pretende ser un sustituto de consejo o asesoría profesional, diagnóstico o tratamiento médico. Siempre procure el consejo de su médico u otro proveedor de salud calificado para cualquier pregunta que usted pueda tener con respecto a una condición médica o pensamientos de suicidio. Nunca ignore el consejo médico profesional o retrase la búsqueda a causa de algo que haya leído en la Aplicación Móvil ANIMA EC.
Si usted piensa que tiene una emergencia médica o si está contemplando actuar sobre pensamientos suicidas, llame al 911 o a la Línea de ayuda de Prevención del Suicidio ANIMA EC (099 719 6911) inmediatamente.
ANIMA EC, y el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil no recomiendan ni aprueban ninguna prueba, médico, producto, procedimiento, opinión u otro dato que pueda ser mencionado o referido en la Aplicación Móvil ANIMA EC. Depender de cualquier y toda información se hace bajo su propio riesgo, aún cuando lo proporcione ANIMA EC, Contribuidores de ANIMA EC, la Junta de Beneficencia de Guayaquil u otros que aparezcan en la Aplicación Móvil ANIMA EC, y/o sus respectivos representantes, colaboradores y sucesores en interés.
APORTACIONES DE USUARIOS
La información personal que usted aporte a ANIMA EC se rige por la Política de Privacidad de ANIMA EC. En la medida en que haya una inconsistencia entre este Acuerdo y la Política de Privacidad de ANIMA EC, este Acuerdo prevalecerá.
PRIVACIDAD DE NIÑOS O MENORES DE 18 AÑOS
Instituto de Neurociencias y ANIMA EC se comprometen a proteger la privacidad de los niños. Usted debe estar consciente de que ANIMA EC no pretende ni está diseñado para atraer a niños menores de 18 años sin la aprobación de padres o tutores. Bajo esta premisa Instituto de Neurociencias, ANIMA EC y sus colaboradores recomiendan que la instalación y uso de la aplicación ANIMA EC en su dispositivo móvil sea bajo la supervisión de un adulto responsable, en caso de ser menor de edad. La información que un menor de edad registre en la aplicación ANIMA EC, será exclusiva responsabilidad del menor y adulto responsable en calidad de supervisor del menor de edad. La información que el menor registre en la aplicación ANIMA EC será exclusivamente de uso del Instituto de Neurociencias y colaboradores para fines investigativos, respetando la confidencialidad y privacidad del menor, así también como cualquier dato que pueda identificar al menor o exponer su identidad.
USO DEL CONTENIDO
Instituto de neurociencias de la Junta de Beneficencia de Guayaquil, le autoriza a ver y/o descargar una sola copia de la Aplicación Móvil ANIMA EC exclusivamente para su uso personal, no comercial. Cualquier regla especial para el uso de cierto software y otros elementos accesibles en ANIMA EC pueden estar incluidos en otra parte dentro del entorno de la Aplicación ANIMA EC y se incorporan a estos Términos y Condiciones por referencia. El Contenido está protegido por leyes estatales. El título al Contenido permanece y pertenece al Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores. Cualquier uso del Contenido que no esté expresamente permitido por estos Términos y Condiciones es un incumplimiento de este Acuerdo y puede violar las leyes de propiedad intelectual que pertenecen al Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y que están debidamente registradas y patentadas en el Servicio Nacional de Derechos Intelectuales SENADI. El Contenido y las características están sujetos a cambio o cancelación sin previo aviso a discreción editorial de Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil. Todo derecho no mencionado expresamente aquí está reservado para Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores.
Si usted viola cualquiera de estos Términos y Condiciones, su autorización para utilizar el contenido termina automáticamente y debe borrar inmediatamente la aplicación y destruir todas las copias que haya hecho de cualquier parte del Contenido.
DERECHOS PATRIMONIALES
Usted reconoce y acuerda que el servicio, información, Contenido y software presentado a través de ANIMA EC o utilizado en relación con la aplicación móvil ANIMA EC contienen información patrimonial y confidencial que está protegida por las leyes de propiedad intelectual nacionales. Con excepción de lo expresamente autorizado por el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil o sus colaboradores, usted acuerda no vender, re escribir, modificar, distribuir, crear trabajos derivados, o alquilar la Aplicación Móvil ANIMA EC, o cualquier información presentada a través de ANIMA EC, en su totalidad o en parte, a ninguna persona. Usted puede ver el Contenido de ANIMA EC, descargar el Contenido y artículos individuales a su dispositivo móvil, e incluso imprimir una copia del Contenido para usted. Sin embargo, usted no podrá remover ninguna propiedad intelectual o patrimonial del Contenido. Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores se reservan todos los demás derechos no concedidos en este Acuerdo. Usted acuerda no acceder a ANIMA EC o su Contenido por ningún otro medio distinto de la interfaz que proporciona el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores.
NINGUNA MANIFESTACIÓN O GARANTÍA
ANIMA EC y el Contenido se proporcionan "tal cual es". Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus respectivos representantes y colaboradores en interés, en la medida en que lo permita la ley, renuncian a toda garantía, expresa o implícita, legal o de otro tipo, incluyendo pero no limitando a las garantías de comercialización, no infracción de derechos de terceros, y aptitud para un propósito particular. Sin perjuicio de lo anterior, Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus respectivos representantes y colaboradores en interés no hacen ninguna manifestación o garantía sobre lo siguiente:
1. La precisión, fiabilidad, integridad, actualidad o lo oportuno del Contenido, software, textos, gráficos, enlaces o comunicaciones previstas en o a través del uso de ANIMA EC.
2. La satisfacción de cualquier reglamento gubernamental que requiera la divulgación de información sobre tratamiento médico, psiquiátrico o psicológico, además de medicamentos con receta o de venta libre, o la aprobación o cumplimiento de cualquier herramienta de software en relación con el contenido que figura en la Aplicación Móvil ANIMA EC.
RESPONSABILIDAD
El uso de ANIMA EC y su Contenido es bajo su propio riesgo. Al usar ANIMA EC, la información puede ser transmitida a través de un medio que puede estar más allá del control y jurisdicción de ANIMA EC y sus proveedores o Colaboradores. En consecuencia, el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores en interés, no asumen ninguna responsabilidad por, o relacionada con, el retraso, fallo, interrupción o corrupción de cualquier dato u otra información transmitida en relación con el uso de la Aplicación Móvil ANIMA EC.
EN NINGÚN CASO el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores en interés o terceras partes mencionados en ANIMA EC, serán responsables por cualquier daño (incluyendo, sin limitación, daños incidentales y consecuentes, daños personales, físicos, emocionales o psicológicos, acción de supervivencia, muerte por negligencia, pérdida de beneficios o daños resultantes de la pérdida de datos o interrupción de la actividad) que resulten del uso de, o imposibilidad de usar ANIMA EC o el Contenido, ya sea basado en garantía, contrato, agravio o cualquier otra teoría legal, y si se le informa o no a Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores en interés, o cualquier tercera parte mencionada en ANIMA EC la posibilidad de tales daños.
Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores en interés o terceros mencionados en ANIMA EC no son responsables por los daños personales, incluyendo la muerte, causados por su uso o mal uso de ANIMA EC o su Contenido. Cualquier reclamación que surja en relación con su uso de ANIMA EC Mobile o cualquier Contenido debe presentarse en el plazo de un (1) semana de la fecha del hecho causante en que dicha acción se produjo. Las reparaciones bajo estos Términos y Condiciones son exclusivos y se limitan a los expresamente previstos en estos Términos y Condiciones.
EN NINGÚN CASO el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus colaboradores en interés o terceras partes mencionados en ANIMA EC, serán responsables de información falsa proporcionada o registrada en la aplicación ANIMA EC por el usuario de la aplicación ANIMA EC; como edad falsa, u otros datos falsos o alterados de forma intencional o por error del propio usuario. Cualquier información proporcionada o registrada en la aplicación ANIMA EC, por el usuario será responsabilidad del mismo.
INDEMNIDAD
Usted acuerda defender, indemnizar y eximir a Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y sus colaboradores, en interés, de y contra cualquier reclamación, acción o demanda, responsabilidad y liquidación incluyendo sin limitación, honorarios legales y de contabilidad razonables, resultantes de, o que se alegue que son el resultado de su violación de estos Términos y Condiciones.
ENLACES A OTROS SITIOS
ANIMA EC puede proporcionar enlaces a sitios web de terceras partes. ANIMA EC también puede seleccionar ciertos sitios como respuestas prioritarias como consecuencia de información proporcionada por usted al configurar la Aplicación Móvil ANIMA EC. El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus colaboradores no recomiendan y no respaldan el contenido de ningún sitio de terceras partes.
El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus colaboradores no son responsables por el contenido de sitios de terceras partes vinculadas, los sitios enmarcados dentro de la aplicación móvil ANIMA EC, los sitios de terceras partes suministrados como resultado de búsquedas o anuncios de terceras partes y no hace ninguna manifestación en cuanto a su contenido o precisión. Su uso de los sitios de terceras partes es bajo su propio riesgo y sujeto a los términos y condiciones de uso de tales sitios. El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus colaboradores no dan garantías o respaldan ningún producto, servicio o tratamiento anunciado en dichos sitios.
GENERAL
ANIMA EC, tiene sede en Guayaquil, Ecuador y la sede principal de negocios se encuentra en El instituto de Neurociencias de Guayaquil, Av. Pedro Menéndez Gilbert. El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus colaboradores no afirman que ANIMA EC, cualquier sitio dentro de ANIMA EC o el contenido sean adecuados o que se pueden descargar fuera de Ecuador. El acceso al contenido, por determinadas personas o en determinados países, posiblemente no sea legal. El acceso a ANIMA EC desde un sitio fuera de los Ecuador, queda bajo su cuenta y riesgo, y usted es responsable por el cumplimiento de las leyes de su jurisdicción.
Las siguientes disposiciones permanecerán vigentes tras la expiración o terminación de este Acuerdo por cualquier motivo que sea: Responsabilidad, indemnización, jurisdicción, divisibilidad, renuncia y acuerdo completo.
JURISDICCIÓN
Usted expresamente acuerda que la jurisdicción exclusiva para cualquier disputa sobre ANIMA EC, o de cualquier manera relacionada con el uso de ANIMA EC, reside en los tribunales de la República del Ecuador, y además acuerda y consiente expresamente al ejercicio de jurisdicción personal en los tribunales de la República del Ecuador en relación con cualquier disputa incluyendo cualquier reclamación que involucre El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil, ANIMA EC y sus colaboradores en interés.
Estos Términos y Condiciones se rigen por las leyes de la República del Ecuador, sin respecto a sus principios de conflicto de leyes.
DIVISIBILIDAD
Si se determina que alguna disposición de estos Términos y Condiciones es inválida por cualquier tribunal de jurisdicción competente, la invalidez de dicha disposición no afectará la validez de las disposiciones restantes de estos Términos y Condiciones, las cuales permanecerán en pleno vigor y efecto.
RENUNCIA
Ninguna renuncia de cualquiera de estos Términos y Condiciones se considerará una renuncia posterior o continuada de dicho término o condición o cualquier otro término o condición. Ninguna demora u omisión en el ejercicio de cualquier derecho o remedio menoscabará ese derecho o remedio, y/o se interpretará como una renuncia.
NOTIFICACIÓN Y PROCEDIMIENTOS DE DESMANTELAMIENTO
Si usted cree que algún material accesible en o de ANIMA EC infringe sus derechos de autor, puede solicitar la remoción del material (o el acceso al mismo) de ANIMA EC poniéndose en contacto directamente con el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil con la siguiente información:
1. Identificación de la obra con derechos de autor que usted cree ha sido infringida. Por favor describa la obra, y de ser posible, incluya una copia o la ubicación (por ejemplo, URL) de una versión autorizada de la obra.
2. Identificación del material que considera infractor y su ubicación. Por favor describa el material y proporciónenos el URL o cualquier otra información pertinente que nos permita localizar el material.
3. Su nombre, dirección, número de teléfono y (si está disponible) e-mail.
4. Una declaración de que usted cree de buena fe que el uso de los materiales del cual se queja no está autorizado por el propietario del derecho de autor, su agente o la ley.
5. Una declaración notariada de que la información que usted ha proporcionado es correcta, e indica que “bajo pena de perjurio” usted es el propietario del derecho de autor o está autorizado para actuar en nombre del propietario del derecho de autor, adjuntado registro de la propiedad intelectual debidamente registrado en su momento en el Instituto Ecuatoriano de la Propiedad Intelectual (IEPI) actualmente conocido como Servicio Nacional de Derechos Intelectuales (SENADI).
6. Una firma o el equivalente electrónico del propietario del derecho de autor o representante autorizado.
ACUERDO COMPLETO
Salvo como se disponga expresamente en un “Aviso Legal” en la Aplicación Móvil ANIMA EC, estos Términos y Condiciones y la Política de Privacidad ANIMA EC constituyen el acuerdo completo entre usted y el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil con respecto al uso de ANIMA EC y su Contenido.
POLÍTICA DE PRIVACIDAD DE ANIMA EC
Esta política describe la información que podemos recopilar sobre usted cuando usted utiliza los servicios puestos a su disposición a través de la aplicación móvil ANIMA EC y cómo esta información puede ser utilizada. Los servicios disponibles a través de la aplicación móvil ANIMA EC pueden ser proporcionados por sitios de terceras partes. Usted debería leer las políticas de privacidad de cada sitio web que usted visite a través de la aplicación móvil ANIMA EC y después de salir de ANIMA EC. El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y ANIMA EC no son responsables de cómo otros sitios web tratan su privacidad.
CAMBIOS EN LA POLÍTICA DE PRIVACIDAD
A medida que esta Política de Privacidad cambie de forma significativa, el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y ANIMA EC tomarán medidas para informarle de los cambios. Cambios menores de esta política de privacidad pueden ocurrir que no afectarán significativamente la forma en que el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y ANIMA EC utilizan su información. En estos casos, El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y ANIMA EC podrían no informarle de tales cambios menores. Cuando esta Política de privacidad cambie de una manera que afecte significativamente la manera en que el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y ANIMA EC manejan información personal, el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y ANIMA EC no aplicarán la nueva Política a la información que ha recopilado previamente de usted sin darle la opción de decidir si es que El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil y ANIMA EC puede o no aplicar la nueva Política a su información en el futuro.
INFORMACIÓN RECOPILADA
Tras la descarga y/o utilización de ANIMA EC, el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil recolecta información personalmente identificable (es decir, información que puede identificar a una persona) sobre su uso de la aplicación a través de, a modo de ejemplo y sin limitación, el uso de cookies, incluso si usted no se ha registrado, incluyendo el sitio web de referencia, en su caso, el tipo de navegador que usted utiliza, la hora y fecha en que accedió a la aplicación. La información que el usuario registre en la aplicación ANIMA EC será exclusivamente de uso del Instituto de Neurociencias y colaboradores para fines investigativos, respetando la confidencialidad y privacidad, así también como cualquier dato que pueda identificar al usuario o exponer su identidad.
USOS DE LA INFORMACIÓN
El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil crea datos agregados sobre los usuarios de ANIMA EC para el desarrollo de productos, mejora de actividades, y para estudios clínicos. El Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil puede proporcionar información sobre los usuarios de ANIMA EC en forma agregada a terceras partes. Cuando se proporciona información agregada a una tercera parte, se agrupa con muchos registros individuales y se despoja de todo dato que pudiera ser utilizado para identificar a un individuo. Cualquier tercera parte que reciba la información agregada debe acordar no intentar volver a identificar a la gente a la que le pertenece. Dependiendo de nuestro acuerdo con la tercera parte, el Instituto de Neurociencias de la Junta de Beneficencia de Guayaquil puede o no cobrar por esta información.

Please read these terms and conditions of use carefully before using ANIMA EC ("Mobile Application").
ANIMA EC, as used in this Agreement, includes any programs and services accessed or used through your mobile device, as well as software modules operating within the application environment that appear on your mobile device.
By using ANIMA EC, you acknowledge and agree to each, and every term and condition set forth in this Agreement. If you do not agree to all these Terms and Conditions of Use, do not use ANIMA EC!
The Neuroscience Institute of the Junta de Beneficencia de Guayaquil, as owner of the ANIMA EC Application, may revise and update these Terms and Conditions at any time. Your continued use of ANIMA EC will mean you accept those changes.
As used in this Agreement, "Collaborators" refers to Neuroscience Institute of the Junta de Beneficencia de Guayaquil, Mental Health Services of the Neuroscience Institute, and any person and entity that has made contributions and/or helped develop the ANIMA EC mobile application.
ANIMA EC DOES NOT PROVIDE MEDICAL ADVICE
The Content of the ANIMA EC Mobile Application, such as text, graphics, images, information obtained from ANIMA EC licensors and other materials contained on ANIMA EC is for informational and psychoeducational purposes only. The Content is not intended to be a substitute for professional advice or counseling, medical diagnosis, or treatment. Always seek the advice of your physician or other qualified health care provider with any questions you may have regarding a medical condition or thoughts of suicide. Never disregard professional medical advice or delay seeking it because of something you have read on the ANIMA EC Mobile Application.
If you think you have a medical emergency or if you are contemplating acting on suicidal thoughts, call 911 or the ANIMA EC Suicide Prevention Helpline (099 719 6911) immediately.
ANIMA EC, and the Neuroscience Institute of the Junta de Beneficencia de Guayaquil do not recommend or endorse any test, physician, product, procedure, or other data that may be mentioned or referenced in the ANIMA EC Mobile Application. Reliance on all information is at your own risk, even if provided by ANIMA EC, ANIMA EC Contributors, the Junta de Beneficencia de Guayaquil or others appearing on the ANIMA EC Mobile Application, and/or their respective representatives, collaborators, and successors in interest.
USER SUBMISSIONS
Personal information you provide to ANIMA EC is governed by ANIMA EC's Privacy Policy. To the extent there is an inconsistency between this Agreement and ANIMA EC's Privacy Policy, this Agreement shall prevail.
PRIVACY OF CHILDREN OR MINORS UNDER 18 YEARS OF AGE
Neuroscience Institute and ANIMA EC are committed to protecting the privacy of children. You should be aware that ANIMA EC is not intended or designed to attract children under the age of 18 without the approval of parents or guardians. Under this premise Neuroscience Institute, ANIMA EC and its collaborators recommend that the installation and use of the ANIMA EC application on your mobile device be under the supervision of a responsible adult, in case you are a minor. The information that a minor register in the ANIMA EC application will be the sole responsibility of the minor and the responsible adult as the minor's supervisor. The information that the minor registers in the ANIMA EC application will be exclusively for the use of the Neuroscience Institute and collaborators for research purposes, respecting the confidentiality and privacy of the minor, as well as any data that may identify the minor or expose his/her identity.
USE OF CONTENT
Neuroscience Institute of the Junta de Beneficencia de Guayaquil, authorizes you to view and/or download a single copy of the ANIMA EC Mobile Application solely for your personal, non-commercial use. Any special rules for the use of certain software and other items accessible on ANIMA EC may be included elsewhere within the ANIMA EC Application environment and are incorporated into these Terms and Conditions by reference. The Content is protected by state law. Title to the Content remains with and belongs to the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its collaborators. Any use of the Content not expressly permitted by these Terms and Conditions is a breach of this Agreement and may violate intellectual property laws that belong to Neuroscience Institute of the Junta de Beneficencia de Guayaquil and are duly registered and patented with the “Servicio Nacional de Derechos Intelectuales - SENADI”. Content and features are subject to change or cancellation without notice at the editorial discretion of Neuroscience Institute of the Junta de Beneficencia de Guayaquil. Any rights not expressly granted herein are reserved by Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its contributors.
If you violate any of these Terms and Conditions, your authorization to use the Content automatically terminates and you must immediately delete the application and destroy all copies you have made of any of the Content.
PROPERTY RIGHTS
You acknowledge and agree that the service, information, Content, and software presented through ANIMA EC or used in connection with the ANIMA EC mobile application contain proprietary and confidential information that is protected by national intellectual property laws. Except as expressly authorized by the Neuroscience Institute of the Junta de Beneficencia de Guayaquil or its collaborators, you agree not to sell, rewrite, modify, distribute, create derivative works, or rent the ANIMA EC Mobile Application, or any information presented through ANIMA EC, in whole or in part, to anyone. You may view the ANIMA EC Content, download the Content and individual items to your mobile device, and even print a copy of the Content for yourself. However, you may not remove any intellectual or proprietary property from the Content. The Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its collaborators reserve all other rights not granted in this Agreement. You agree not to access ANIMA EC or its Content by any means other than through the interface provided by the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its collaborators.
NO REPRESENTATION OR WARRANTY
ANIMA EC and the Content are provided "as is". the Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its respective representatives and contributors in interest, to the fullest extent permitted by law, disclaim all warranties, express or implied, statutory, or otherwise, including but not limited to warranties of merchantability, non-infringement of third-party rights, and fitness for a particular purpose. Without limiting the foregoing, the Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its respective representatives and contributors in interest make no representations or warranties as to the following:
1. The accuracy, reliability, completeness, timeliness or appropriateness of the Content, software, text, graphics, links, or communications provided on or using ANIMA EC.
2. The satisfaction of any governmental regulations requiring the disclosure of medical, psychiatric, or psychological treatment information, in addition to prescription or over-the-counter medications, or the approval or compliance of any software tools in connection with the Content contained in the ANIMA EC Mobile Application.
RESPONSIBILITY
Use of ANIMA EC and its Content is at your own risk. In using ANIMA EC, information may be transmitted over a medium that may be beyond the control and jurisdiction of ANIMA EC and its suppliers or Contributors. Accordingly, the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its collaborators in interest, assume no liability for, or related to, the delay, failure, interruption or corruption of any data or other information transmitted in connection with the use of the ANIMA EC Mobile Application.
IN NO EVENT shall the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its collaborators in interest or third parties mentioned in ANIMA EC, be liable for any damages (including, without limitation, incidental and consequential damages, personal, physical, emotional or psychological damages, survival action, wrongful death, loss of profits or damages resulting from loss of data or business interruption) resulting from the use of, or inability to use ANIMA EC or the Content, whether based on warranty, contract, tort or any other legal theory, and whether or not the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its contributors in interest, or any third party mentioned in ANIMA EC are advised of the possibility of such damages.
the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its collaborators in interest or third parties mentioned in ANIMA EC are not liable for personal injury, including death, caused by your use or misuse of ANIMA EC or its Content. Any claim arising in connection with your use of ANIMA EC Mobile or any Content must be filed within one (1) week of the date of the causative event in which such action occurred. Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.
IN NO EVENT shall the Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its collaborators in interest or third parties mentioned in ANIMA EC, be responsible for false information provided or registered in the ANIMA EC application by the user of the ANIMA EC application, such as false age, or other false or altered data intentionally or by the user's own error. Any information provided or recorded in the ANIMA EC application by the user shall be the responsibility of the user.
INDEMNITY
You agree to defend, indemnify, and hold harmless Neuroscience Institute of the Junta de Beneficencia de Guayaquil and its collaborators, in interest, from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
LINKS TO OTHER WEBSITES
ANIMA EC may provide links to third party websites. ANIMA EC may also select certain sites as priority responses because of information provided by you when configuring the ANIMA EC Mobile Application. The Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its collaborators do not recommend and do not endorse the content of any third-party sites.
The Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its collaborators are not responsible for the content of linked third party sites, sites framed within the ANIMA EC mobile application, third party sites provided because of third-party searches or advertisements and makes no representations as to their content or accuracy. Your use of third-party sites is at your own risk and subject to the terms and conditions of use of such sites. The Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its contributors do not warrant or endorse any products, services or treatments advertised on such sites.
GENERAL
ANIMA EC is headquartered in Guayaquil, Ecuador and the principal place of business is located at the Neuroscience Institute of Guayaquil, Av. Pedro Menéndez Gilbert. The Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its contributors make no representation that ANIMA EC, any site within ANIMA EC or the content is appropriate or may be downloaded outside of Ecuador. Access to the content, by certain persons or in certain countries, may not be legal. Access to ANIMA EC from a site outside of Ecuador is at your own risk, and you are responsible for compliance with the laws of your jurisdiction.
The following provisions shall survive the expiration or termination of this Agreement for any reason whatsoever: Liability, Indemnification, Jurisdiction, Severability, Waiver and Entire Agreement.
JURISDICTION
You expressly agree that exclusive jurisdiction for any dispute over ANIMA EC, or in any way related to the use of ANIMA EC, resides in the courts of the Republic of Ecuador, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the Republic of Ecuador in connection with any dispute including any claim involving the Neuroscience Institute of the Junta de Beneficencia de Guayaquil, ANIMA EC and its collaborators in interest.
These Terms and Conditions are governed by the laws of the Republic of Ecuador, without respect to its conflict of laws principles.
SEVERABILITY
If any provision of these Terms and Conditions is determined to be invalid by any court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
WAIVER
No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition. No delay or failure to exercise any right or remedy shall impair such right or remedy, and/or be construed as a waiver.
NOTICE AND TAKEDOWN PROCEDURES
If you believe that any material accessible on or from ANIMA EC infringes your copyright, you may request removal of the material (or access to it) from ANIMA EC by contacting the Neuroscience Institute of the Junta de Beneficencia de Guayaquil directly with the following information:
1. Identification of the copyrighted work that you believe has been infringed. Please describe the work, and if possible, include a copy or the location (e.g., URL) of an authorized version of the work.
2. Identification of the material that you believe to be infringing and its location. Please describe the material and provide us with the URL or other pertinent information that will enable us to locate the material.
3. Your name, address, telephone number and (if available) e-mail address.
4. A statement that you have a good faith belief that the use of the material complained of is not authorized by the copyright owner, its agent, or the law.
5. A notarized statement that the information you have provided is correct and indicates that "under penalty of perjury" you are the copyright owner or are authorized to act on behalf of the copyright owner, enclosing the intellectual property registration duly registered at the time with the Ecuadorian Institute of Intellectual Property (IEPI) currently known as the National Service of Intellectual Rights (SENADI).
6. A signature or the electronic equivalent of the copyright owner or authorized representative.
ENTIRE AGREEMENT
Except as expressly provided in a "Legal Notice" on the ANIMA EC Mobile Application, these Terms and Conditions and the ANIMA EC Privacy Policy constitute the entire agreement between you and the Neuroscience Institute of the Junta de Beneficencia de Guayaquil with respect to your use of ANIMA EC and its Content.
ANIMA EC PRIVACY POLICY
This policy describes the information we may collect about you when you use the services made available to you through the ANIMA EC mobile application and how this information may be used. The services available through the ANIMA EC mobile application may be provided by third party sites. You should read the privacy policies of each website you visit through the ANIMA EC mobile application and after you leave ANIMA EC. The Neuroscience Institute of the Junta de Beneficencia de Guayaquil and ANIMA EC are not responsible for how other websites treat your privacy.
CHANGES TO THE PRIVACY POLICY
As this Privacy Policy changes significantly, Neuroscience Institute of the Junta de Beneficencia de Guayaquil and ANIMA EC will take steps to inform you of the changes. Minor changes to this Privacy Policy may occur that will not significantly affect how the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and ANIMA EC use your information. In these cases, the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and ANIMA EC may not inform you of such minor changes. When this Privacy Policy changes in a way that significantly affects the way the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and ANIMA EC handle personal information, the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and ANIMA EC will not apply the new Policy to information it has previously collected from you without giving you a choice as to whether or not the Neuroscience Institute of the Junta de Beneficencia de Guayaquil and ANIMA EC may apply the new Policy to your information in the future.
INFORMATION COLLECTED
Upon downloading and/or using ANIMA EC, the Neuroscience Institute of the Junta de Beneficencia de Guayaquil collects personally identifiable information (i.e., information that can identify an individual) about your use of the application through, by way of example and without limitation, the use of cookies, even if you have not registered, including the referring website, if applicable, the type of browser you use, the time and date you accessed the application. The information that the user registers in the ANIMA EC application will be exclusively for the use of the Neurosciences Institute and collaborators for research purposes, respecting confidentiality, and privacy, as well as any data that may identify the user or expose his or her identity.
USES OF THE INFORMATION
The Neuroscience Institute of the Junta de Beneficencia de Guayaquil creates aggregate data about ANIMA EC users for product development, enhancement activities, and clinical studies. The Neuroscience Institute of the Junta de Beneficencia de Guayaquil may provide information about ANIMA EC users in aggregate form to third parties. When aggregate information is provided to a third party, it is grouped with many individual records and stripped of any data that could be used to identify an individual. Any third party that receives the aggregated information must agree not to attempt to re-identify the people to whom it pertains. Depending on our agreement with the third party, the Neuroscience Institute of the Junta de Beneficencia de Guayaquil may or may not charge for this information.
